By using our services, both Hosts and Guests engage directly with us for all matters related to the listed properties.
2. Eligibility and Account Registration
- 2.1 Eligibility: You must be at least 18 years old and capable of entering into legally binding contracts to use our services. By using the Platform, you represent and warrant that you meet these requirements.
- 2.2 Account Registration: To access certain features of the Platform, such as making a booking or managing a property, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- 2.3 Account Security: You must immediately notify us at support@techwaveproperties.com if you suspect any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account information.
3. Property Listings and Management
- 3.1 Property Management: As the managing entity, Techwave Properties Ltd. is responsible for the day-to-day management of all properties listed on our Platform. This includes, but is not limited to, coordinating property maintenance, handling guest inquiries, and ensuring the property is in compliance with all applicable laws and regulations.
- 3.2 Creating a Listing: Property owners (“Hosts”) may submit their properties for listing on our Platform. Listings must include accurate and complete information about the property, including its location, amenities, pricing, and any rules or restrictions that apply to Guests. Techwave Properties Ltd. reserves the right to edit or remove any listings that do not meet our standards.
- 3.3 Accuracy of Listings: Hosts are responsible for providing accurate and up-to-date information about their properties. Any changes to the property, its availability, or the terms of the rental must be promptly communicated to us so that the listing can be updated accordingly.
- 3.4 Host Compliance: Hosts must ensure that their properties comply with all local laws, regulations, and third-party agreements, including zoning laws, rental restrictions, and homeowner association rules. Techwave Properties Ltd. will assist in ensuring compliance but the ultimate responsibility rests with the Host.
- 3.5 Property Maintenance and Safety: Techwave Properties Ltd. is responsible for maintaining the properties in a safe, clean, and habitable condition. This includes routine maintenance, emergency repairs, and ensuring that all amenities and features listed in the property description are available and in good working order.
4. Booking and Payment Terms
- 4.1 Booking Process: Guests can book properties through our Platform by following the booking process outlined on the website. A booking is confirmed when Techwave Properties Ltd. accepts the booking request and the Guest receives a confirmation email. At this point, a legally binding agreement is formed between the Guest and Techwave Properties Ltd.
- 4.2 Payment Terms: Guests agree to pay the total amount for the booking, including the property rental, applicable fees, taxes, and any other charges specified during the booking process. Payments are processed securely through our payment service providers.
- 4.3 Service Fees: We may charge service fees to Hosts and Guests for the use of our Platform. These fees are disclosed at the time of booking and are non-refundable, except as provided in our Refund Policy.
- 4.4 Cancellations and Refunds: The cancellation policy for each booking is determined by Techwave Properties Ltd. and will be clearly stated in the booking confirmation. Guests should review the cancellation policy before making a booking. Refunds, if applicable, will be processed according to our Cancellation Policy.
- 4.5 Booking Modifications: Any modifications to bookings must be made through Techwave Properties Ltd. and may be subject to additional charges or fees, which will be communicated at the time of the modification.
5. Guest Responsibilities
- 5.1 Compliance with Property Rules: Guests agree to comply with the rules and guidelines set forth in the property listing, as well as any additional instructions provided by Techwave Properties Ltd. or the Host. Guests are responsible for ensuring that their conduct does not cause damage to the property or disturb the surrounding neighborhood.
- 5.2 Damage to Property: Guests are responsible for any damage they cause to the property during their stay. In the event of damage, Guests agree to pay for the cost of repairs or replacements, as determined by Techwave Properties Ltd. in accordance with our Damage Policy.
- 5.3 Use of Property: Guests must use the property solely for its intended purpose and in accordance with the terms of the rental agreement. Unauthorized use, including subletting the property or hosting unauthorized events, may result in immediate termination of the booking and forfeiture of any payments made.
- 5.4 Check-In and Check-Out: Guests must adhere to the check-in and check-out times specified in the booking confirmation. Any changes to these times must be agreed upon in advance with Techwave Properties Ltd. Failure to check out on time may result in additional charges.
6. Host Responsibilities
- 6.1 Property Maintenance: While Techwave Properties Ltd. is responsible for the daily management of the properties, Hosts are expected to ensure that their properties meet all legal requirements and are suitable for rental. This includes addressing any structural issues, complying with local health and safety regulations, and providing necessary amenities.
- 6.2 Communication with Techwave: Hosts must maintain open and prompt communication with Techwave Properties Ltd., especially regarding any changes to the property or issues that may affect a Guest’s stay. Failure to communicate important updates may result in penalties or the removal of the listing from our Platform.
- 6.3 Legal Compliance: Hosts must ensure their properties comply with all applicable laws and regulations, including obtaining any necessary licenses or permits for rental activities. Techwave Properties Ltd. will assist with compliance but cannot be held liable for a Host’s failure to meet legal obligations.
- 6.4 Taxes: Techwave Properties Ltd. will assist in collecting and remitting applicable taxes on behalf of Hosts, where required by law. However, Hosts remain responsible for understanding their tax obligations and ensuring compliance with all applicable tax laws.
7. Reviews and Feedback
- 7.1 Submission of Reviews: After a booking is completed, both Guests and Hosts have the opportunity to submit a review. Reviews must be accurate, honest, and respectful. We do not verify the accuracy of reviews and are not responsible for the content of reviews posted on our Platform.
- 7.2 Content Guidelines: Reviews and other content posted by users must comply with our content guidelines, which prohibit discriminatory, offensive, defamatory, or misleading content. We reserve the right to remove any content that violates these guidelines.
8. Dispute Resolution
- 8.1 Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
- 8.2 Dispute Resolution Process: In the event of a dispute between you and another user or between you and Techwave Properties Ltd., we encourage you to contact us directly to resolve the issue. If a resolution cannot be reached through our internal dispute resolution process, the dispute may be submitted to binding arbitration in accordance with the rules of the London Court of International Arbitration.
9. Limitation of Liability
To the fullest extent permitted by law, Techwave Properties Ltd. will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from or related to our services shall not exceed the total amount paid by you for the use of our services in the six months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Techwave Properties Ltd., its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any rights of another.
11. Termination and Suspension
- 11.1 Termination by You: You may terminate your account at any time by contacting us at support@techwaveproperties.com. Upon termination, you will remain responsible for any outstanding obligations related to your account.
- 11.2 Termination by Us: We may suspend or terminate your account or access to our services at any time, with or without notice, for any reason, including if you violate these Terms, fail to comply with applicable laws, or engage in conduct that we deem harmful to our business or users.
- 11.3 Effect of Termination: Upon termination of your account, any confirmed bookings will be automatically canceled, and refunds may be issued in accordance with the cancellation policy of the affected booking. You will not be entitled to any compensation for termination, and any content you have posted to the Platform may no longer be accessible.
12. Intellectual Property
- 12.1 Ownership: All content and materials on the Platform, including text, graphics, logos, images, and software, are the property of Techwave Properties Ltd. or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, distribute, or create derivative works from any content on the Platform without our prior written consent.
- 12.2 User Content: By submitting content to the Platform, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, display, reproduce, and distribute your content in connection with the operation of the Platform. You represent and warrant that you have the rights to grant this license and that your content does not infringe the rights of any third party.
